The bench of Supreme Court (SC) hearing a case against ‘Provisional Constitution Order’ (PCO) judges stood dissolved on Monday following the refusal by Justice Sair Ali to be part of the bench.
The five-member bench of the apex court headed by Justice Sair Ali was hearing a case against the judges who took oath under PCO.
Earlier, the SC had reserved its decision on Friday following the objection raised by Dr Abdul Baist about composition of the bench.
Abdul Basit had objected on the presence of Justice Sair Ali, Justice Tariq Pervez and Justice Shahid Siddiqui.
Justice Sair Ali refused to sit in the bench on Monday and requested the Chief Justice Iftikhar Mohammad Chaudhary to constitute a new bench for the case.
