ISLAMABAD: The Islamabad High Court (IHC) on Tuesday dismissed appeal filed against Allauma Sajid Naqvi, chief of the banned Islami Tehrik Pakistan allegedly involved in the assassination of Mualana Azim Tariq, leader of the banned outfit Sipah-e-Sahaba.
Whereas IHC issued notices to two main accused namely Muhammad Ali and Mudassir Ali main accused in the murder that were released by Anti Terrorist Court (ATC) Rawalpindi, earlier.
A two-judge bench headed by Justice Noorul Haq Qureshi comprising Justice Shukat Aziz Siddiqui heard the appeal filed by Maulana Alim Tariq against Anti Terrorist Court (ATC) Rawalpindi’s verdict in Maulana Azam Tariq murder case.
During the course of proceedings, Bisharrat Ullah counsel for Maulana Alim Tariq alleged that the assassination plan of Maulana Azam Tariq had been finalized at the residence of Jamaat-i-Islami then chief Qazi Hussain Ahmed.
He argued that the PWs- Imtiaz Hussain and Shaikh Imran – belong to Jhang alleged that they were present at the residence of Qazi Hussain Ahmed in Islamabad where a meeting of the Muttahida Majlis-i-Amal was in progress.
They claimed that after some time Allama Sajid Naqvi came out of the meeting room and joined Sabtain Kazmi and Amanullah Siyal, both co-accused in the same case, who had been waiting for Allama Naqvi in the room where they (PWs) were present.
Bisharat cited their statements and said Allama Naqvi, took both the co-accused to a corner of the room and directed them to remove Maulana Azam Tariq from his way as Maulana Tariq was a hurdle in the way of spreading and promoting Fiqah Jaferiya in the country.
The PWs had further recorded that Sabtain Kazmi and Amanullah Siyal had promised to provide men and arms for the assassination of Maulana Azam Tariq.
Bisharrat pleaded before the court to declare ATC orders null and void which declared Maulana Sajid innocent.
Both the judges remarked that how it possible that such a sensitive conspiracy was made in such public place and especially before these witnesses it seemed totally un-natural and un-plasmatic.
Subsequently, the bench dismissed the appeal related to the Maulana Sajid Naqvi, whereas the plea to call the main accused allowed and issued notices to them.
